City Attorney Mark Hensley announced that the Chino Hills City Council voted in
closed session to file a request with the California Supreme Court to accept review of the
Court of Appeal’s September 12 decision that affirmed the S.B. County Superior Court
Judge’s ruling that the Superior Court does not have jurisdiction with regard to the complaint
the City filed against SCE based on Tehachapi Renewable Transmission Project (TRTP)
Segment 8A "overburdening the easement over City property." (Court of Appeal Case
#E051033.) The vote was 3 to 0 with Council Members Gwenn Norton-Perry and Peter
Rogers abstaining due to a potential conflict of interest because of the proximity of their
homes to the Tehachapi Renewable Transmission Project.
“The City has been working toward a solution for over four years,” said Mayor Ed
Graham. “The City Council felt that it was important for us to take this step, the last step
available to us.”
“The California Supreme Court accepts very few cases for review,” said Mr. Hensley.
“They don’t take a case just because they disagree with the lower court’s ruling. They review
cases where there is an issue of uniformity in the lower courts or an overriding public policy
issue that makes it important to review a case.”
According to Mr. Hensley, the City expects to file the case within about three weeks. A
decision from the Supreme Court about whether to accept or reject the City’s request for
review will be rendered by mid-January 2012.
